DMCA Policy

1. Overview

HappyMod respects the intellectual property rights of others and expects users, developers, publishers, uploaders, and all other parties using or interacting with HappyMod to do the same.

This DMCA Policy explains how HappyMod handles claims of copyright infringement under the Digital Millennium Copyright Act and other applicable copyright laws. It describes the process for submitting copyright takedown notices, how HappyMod reviews and responds to those notices, and how affected users may submit counter-notifications when they believe content was removed or disabled by mistake or misidentification.

HappyMod does not knowingly permit copyright-infringing content to remain available on its services. When HappyMod receives a valid copyright infringement notice, it may remove or disable access to the allegedly infringing content and take appropriate action against the responsible user, account, uploader, or contributor.

2. Scope of This Policy

This Policy applies to content made available through HappyMod, including but not limited to:

  • Application listings
  • APK files or other downloadable files
  • App descriptions, titles, metadata, images, icons, screenshots, and promotional materials
  • User-submitted content
  • Developer-submitted content
  • Comments, reviews, or other public submissions
  • Any other material hosted, indexed, displayed, distributed, or made accessible through HappyMod

This Policy is intended only for copyright-related complaints. It does not apply to trademark claims, privacy complaints, defamation claims, contractual disputes, or other non-copyright matters.

3. Copyright Infringement Policy

HappyMod prohibits users from uploading, submitting, posting, distributing, or otherwise making available any content that infringes another party’s copyright.

Users may only submit content if they:

  • Own the copyright in the content;
  • Have permission from the copyright owner;
  • Are authorized by law to use and distribute the content; or
  • Have another valid legal basis for making the content available.

HappyMod may remove or disable access to content that is alleged to infringe copyright, even before a final legal determination is made, when the notice substantially complies with applicable law.

HappyMod may also terminate or restrict access for users who repeatedly infringe copyrights or repeatedly submit infringing content.

4. Submitting a DMCA Takedown Notice

If you are a copyright owner, or authorized to act on behalf of a copyright owner, and you believe that content available through HappyMod infringes your copyright, you may submit a written DMCA takedown notice to HappyMod’s designated copyright agent through HappyMod’s official copyright complaint process.

To be effective, your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

  2. Identification of the copyrighted work claimed to have been infringed.
    If multiple copyrighted works are covered by one notice, provide a representative list of those works.

  3. Identification of the allegedly infringing material that you request HappyMod to remove or disable.
    You must provide enough detail to allow HappyMod to locate the specific content, including the name of the app, listing, file, page, or other identifying information.

  4. Information reasonably sufficient to allow HappyMod to communicate with the complaining party regarding the notice.

  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner’s agent, or the law.

  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

A DMCA notice that does not include the required information may be rejected or may result in delayed processing.

5. Good-Faith Requirement

By submitting a DMCA takedown notice, you represent that you have a good-faith belief that the identified use is not authorized by the copyright owner, the copyright owner’s agent, or the law.

Before submitting a notice, you should consider whether the use may be authorized by law, including under doctrines such as fair use, license, permission, public domain status, or other legal exceptions.

Submitting false, misleading, incomplete, or bad-faith notices may result in legal liability.

6. HappyMod’s Response to DMCA Notices

After receiving a substantially valid DMCA takedown notice, HappyMod may take one or more of the following actions:

  • Review the notice for completeness and validity;
  • Remove or disable access to the allegedly infringing material;
  • Notify the user or uploader responsible for the content;
  • Provide the user with information about the claim;
  • Preserve records related to the claim as required or permitted by law;
  • Take action under HappyMod’s repeat infringer policy;
  • Decline to act if the notice is incomplete, invalid, abusive, fraudulent, or otherwise legally insufficient.

Removal or disabling of access does not mean that HappyMod has made a final determination that copyright infringement occurred. It means HappyMod has acted in response to a copyright claim under applicable law.

7. Counter-Notification Process

If your content was removed or disabled because of a DMCA takedown notice, and you believe the removal or disabling was the result of mistake or misidentification, you may submit a counter-notification.

A valid counter-notification must include all of the following:

  1. Your physical or electronic signature.

  2. Identification of the material that was removed or disabled, and the location where the material appeared before it was removed or disabled.

  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Your consent to the jurisdiction of the appropriate federal district court.
    If you are located in the United States, this means the federal judicial district where you are located. If you are located outside the United States, this means any federal judicial district in which HappyMod may be found.

  5. A statement that you will accept service of process from the person who submitted the original DMCA notice or that person’s authorized agent.

  6. Information reasonably sufficient to allow HappyMod and the complaining party to communicate with you regarding the counter-notification.

Counter-notifications that do not include the required information may be rejected or may result in delayed processing.

8. Restoration of Removed Content

After HappyMod receives a valid counter-notification, HappyMod may forward it to the person who submitted the original DMCA notice.

Unless the original complaining party notifies HappyMod that they have filed a court action seeking to restrain the user from engaging in infringing activity related to the disputed material, HappyMod may restore the removed content or re-enable access to it within the timeframe permitted by the DMCA.

HappyMod is not required to restore content if:

  • The counter-notification is incomplete or invalid;
  • The content violates other HappyMod policies;
  • The content violates applicable law;
  • The account has been suspended or terminated for unrelated reasons;
  • HappyMod determines that restoration is inappropriate under the circumstances.

9. Repeat Infringer Policy

HappyMod maintains a policy for terminating or restricting users who are repeat infringers.

HappyMod may consider a user a repeat infringer if the user has repeatedly uploaded, submitted, distributed, or made available content that is subject to valid copyright complaints.

Actions against repeat infringers may include:

  • Removal of content;
  • Disabling of uploads or submissions;
  • Temporary suspension;
  • Permanent account termination;
  • Blocking access to certain features;
  • Other measures HappyMod considers appropriate.

HappyMod may also take action against users who submit false counter-notifications, abuse the DMCA process, evade enforcement measures, or repeatedly repost removed content.

10. Misrepresentations and Abuse

Any person who knowingly materially misrepresents that content is infringing, or that content was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, under applicable law.

HappyMod reserves the right to reject, disregard, or take action against notices or counter-notifications that appear to be:

  • Fraudulent;
  • Abusive;
  • Duplicative;
  • Incomplete;
  • Submitted in bad faith;
  • Intended to harass, silence, or intimidate another party;
  • Not related to copyright infringement;
  • Legally insufficient.

11. No Legal Determination by HappyMod

HappyMod does not act as a court, arbitrator, or final decision-maker in copyright disputes.

HappyMod’s response to a DMCA notice or counter-notification is based on the requirements of applicable copyright law and HappyMod’s policies. HappyMod does not determine ownership of copyrights, resolve licensing disputes, or decide whether a particular use is legally protected.

Parties involved in a copyright dispute are responsible for resolving their claims directly or through the appropriate legal process.

12. Content Removed for Other Reasons

HappyMod may remove or disable access to content for reasons unrelated to copyright, including but not limited to:

  • Violation of HappyMod’s terms or policies;
  • Security concerns;
  • Malware, harmful code, or deceptive behavior;
  • Illegal activity;
  • Abuse of HappyMod’s services;
  • User safety concerns;
  • Requests from rights holders or authorities where legally appropriate.

A DMCA counter-notification does not guarantee restoration of content removed for reasons other than copyright.

13. Policy Updates

HappyMod may update this DMCA Policy from time to time to reflect changes in law, operational practices, or service features.

The updated version will apply once published. Continued use of HappyMod after changes are published means you accept the revised Policy.
